1. About these terms
These terms are an agreement between you and the business named on our Contact page ("we", "us"), which provides The Starly at thestarly.com and in its installed app. By ticking the box when you start, you agree to these terms, including our refund and cancellation policy, which is part of them, and to our privacy policy. Nothing in these terms takes away your rights under the Consumer Protection Act, 2019. When these terms say we will tell you something, we do it by a notice in the app or a message to the email or number you sign in with.
2. Who can use The Starly
You must be 18 or older. You confirm this when you start. If you tell us, or we learn in another way, that an account belongs to someone younger, we close it and delete its data, except payment records the law makes us keep. One account is for one person. The Starly is for people in India for now, and cards issued outside India can't be used.
3. What Starly is
- Starly is an AI. The Starly is an artificial intelligence service. No person writes your readings or chooses your cards.
- For reflection, not prediction. Readings are for reflection, guidance and entertainment. They are not predictions, and nothing in them is guaranteed to happen. The cards suggest; you decide.
- Not advice. Starly does not give medical, mental health, legal or financial advice, and is not a substitute for a doctor, counsellor, lawyer or financial adviser. Please don't make decisions about your health, safety, legal matters or money because of a reading.
- No remedies. We don't offer or sell remedies, rituals, mantras, gemstones or anything else to treat, cure or prevent any illness or condition. Starly is told not to suggest them. If it ever does, don't rely on it, and tell us.
- AI can be wrong. Starly can misunderstand you or say something that doesn't fit your situation. Check anything important with a real person.
- Cards are drawn at random. Cards are drawn by our system, not chosen by the AI.
- Messages from Higher Realms are short messages Starly writes from the meaning of the card you draw, in the style of the deck you chose. The name describes the style of the decks. We don't claim that any message comes from a deity, spirit or other supernatural source.
- Your wellbeing. Starly is not an emergency service and cannot contact anyone for you. If you might harm yourself or are in danger, call 112, or Tele-MANAS on 14416 (free, any time). Our safety page explains what Starly does when someone may be at risk.
4. Your account
Keep your sign-in to yourself. You are responsible for what is done through your account. Tell us at once through the Contact page if you think someone else has used it.
5. Plans, packs and prices
- Free. When you join you get one free welcome reading. More readings need a plan. Your daily reading stays free.
- Free on the landing page. The landing page offers one free card a day and can offer two free questions on one device, without an account. We may pause or stop these at any time.
- Plans. Plans are monthly and give a number of questions each month, as shown on the plans page when you buy. A month's unused questions end with that month and don't carry over.
- Top-up packs. If you have a plan, you can buy extra questions in packs. A pack lasts 12 months from purchase. Pack questions can be used only while you have an active plan. If your plan ends, your pack questions wait for your next plan until the pack's end date.
- Codes. A code gives the discount shown at checkout. Each code works once per account, unless we say otherwise when we give it to you, and codes can't be combined. On a plan, a code covers your first month only, unless we say otherwise, and you pay the full price after that. A code has no cash value. We may end a code at any time, and that doesn't change a price you've already paid.
- Prices include GST. The price you see is the price you pay. You get a tax invoice for every payment under Payments and invoices. You must give the state you live in at checkout, because GST law uses it on your invoice. Invoices are issued to individuals and a GSTIN can't be added.
- How questions are used. A reading uses its questions when it is shown to you in full. If a reading fails before you see it, its questions are given back. There is a limit of 40 questions a day.
- Price changes. We will tell you at least 30 days before a new price would apply to your plan. It applies only if you agree to it and authorise it. If you don't, your plan ends at the end of the month you've paid for and nothing more is charged.
6. Renewal and cancelling
- Plans renew each month at the price you agreed to, until you cancel. You approve the first payment and a repeating mandate. Your bank or UPI app tells you at least 24 hours before each payment and lets you stop it.
- Cancel any time in Your plan: one tap and a confirm. There is no fee. Your plan runs to the end of the month you've paid for, then stops. You can also stop renewals by cancelling the mandate in your UPI app or with your card's bank.
- If a renewal payment fails, your plan stays on for 3 days while the payment is retried.
- Refunds are covered by our refund and cancellation policy, which is part of these terms.
7. Your content
- What you write stays yours: your questions, journal, moods, notes and the people you save. You let us store, use and show it only to provide The Starly to you, including sending it to the services named in our privacy policy to write your readings. We never use it for advertising, and we use only AI services whose terms say they don't train on it.
- Your readings are yours to keep. To the extent we have any rights in the words of your readings, we give them to you. You may keep, copy and share your readings. Readings can be similar to readings others receive.
- Our materials stay ours. The app, its text, our card meanings, deck names, original card art, our logo and The Starly name belong to us or to those who license them to us. You may keep and share your own readings that include them, but not copy the decks or meanings as a set or use them commercially.
- Information about other people. When you add someone to My People, ask about them or write about them, you confirm that you know them, that you add only what a reading needs, and that you have the right to share it. Don't add anything that could harm them, don't add details such as their phone, email, address or ID numbers, and don't add details of anyone under 18 beyond a name and how they're related to you.
8. Things you must not do
Don't use The Starly to host, share or ask for anything that:
- belongs to someone else and you have no right to;
- is obscene, pornographic or paedophilic, invades someone's bodily privacy, or insults or harasses anyone because of their gender, religion, caste or race;
- harms a child in any way, promotes enmity between groups, or relates to money laundering or gambling;
- infringes a patent, trade mark, copyright or other right;
- deceives people, spreads what you know is false, or pretends to be someone else;
- threatens the unity, security or sovereignty of India, its friendly relations with other countries or public order, or stops an offence being investigated;
- contains a virus or code meant to damage a system, or breaks any law in force.
Don't try to break, overload or get around the app's security, limits or payments, copy the app or its content in bulk, get into anyone's accounts or devices, or let someone under 18 use your account.
Starly will decline some requests, such as predicting when someone will die, picking lottery numbers, hurting someone, crime, hacking and explicit sexual content.
If you break these terms, we may limit or close your account, or remove what breaks them, after telling you why, unless the law or safety requires us to act first. Unlawful content can lead to a penalty under the law, and where the law requires us to report something to the authorities, we will. You can report a reply with Report beside it, or write to us through the Contact page.
9. Changes to The Starly and to these terms
We may change features. If we remove something you've paid for in a way that matters, we will tell you and refund the unused part. When we change these terms we publish a new version with its date and, if the change affects you, ask you to agree the next time you open the app.
10. Ending your account
You can delete your account at any time in Your data and account. This first stops any renewal, and if a renewal can't be stopped the app tells you and your account stays until it can. Paid days and unused questions end with the account and aren't refunded, unless the refund policy says otherwise. What is deleted and what is kept is in our privacy policy. We may close an account under section 8, or if we stop providing The Starly, in which case we will give you 30 days' notice and time to download your data, and refund the unused part of your plan and packs.
11. Our responsibility to you
- We provide The Starly with reasonable care and skill, and as described in these terms.
- Readings are for reflection, guidance and entertainment, so we are not responsible for decisions you make because of one.
- The app can sometimes be unavailable, for example during maintenance or a fault at a service we rely on. We are not responsible for delays or failures caused by events outside our reasonable control.
- Our total responsibility to you for any claim is limited to what you paid us in the 12 months before it, or ₹1,000 if that is more.
- Nothing here limits a responsibility that the law doesn't allow us to limit, including your rights under the Consumer Protection Act, 2019, and our responsibility for a deficient service, an unfair trade practice, fraud, a failure to protect your personal data, or death or injury caused by our negligence.
12. Complaints, law and disputes
Write to our grievance officer first, through the Contact page. We reply within 48 hours and work to resolve every complaint within 7 days, and never later than one month. You can also call the National Consumer Helpline on 1915, or file a complaint with a Consumer Commission through e-Jagriti.
These terms are governed by the laws of India, and courts in India have jurisdiction. This doesn't limit your right to file a consumer complaint where you live or work, as the law allows.
13. The rest
If one part of these terms can't be enforced, the rest still applies. We may transfer these terms to a new owner of The Starly, who will be bound by them. We will tell you at least 30 days before, and you can cancel and delete your account if you don't want to continue. Not acting on a right doesn't give it up. Our details are on the Contact page.
